Privacy Policy – Company Wide and Public Distribution

 

1. ICE Entertainment PTY LTD t/a Atomic Music Australia

1A. All services and products supplied by ‘ICE ENTERTAINMENT PTY LTD’ – ACN 634 395 501 (hereinafter referred to as “IE”) to the ARTIST, CLIENT or CUSTOMER (hereinafter referred to as the “Artist”) are supplied on these terms and conditions of service. A current copy of this document is available on the Atomic Music website (http://www.atomicmusic.space) and is subject to being updated from time to time without direct notification. Any and all changes are updated through a public article released on the “Atomic News” section of the Atomic Music website. 2. What kinds of personal information does IE collect and hold?

2A. Personal information is any information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be personal information regardless of whether it is true. We only collect personal information that we need for one or more of our business activities. Some examples of the sort of personal information that IE will collect and hold include, contact details of its members, artists and clients; details of artists and their recordings; contact details for people we deal with at other organisations which IE has business relationships, such as music retailers, industry or trade associations, media organisations, government authorities and suppliers of goods and services.

2B. Most of the personal information IE collects relates to individuals in their business or professional capacities, so we only collect this information as an incident of a business relationship with an individual or the organisation they work for. Occasionally, we may collect personal information about individuals in their private capacities, for example where an individual subscribes to receive IE publications; opts in to receive information about IE’s services; makes an inquiry by phone or email; makes a complaint; makes a comment via our social channels; submits a competition entry form or applies for a job with IE.

2C. IE usually does not need to collect any sensitive information such as information about gender, racial or ethnic origin, political activities or affiliations, memberships of unions or other associations, religion, sexual preferences or practices, criminal record or medical history. If we do collect or hold such information, we will only do so strictly in accordance with the APPs in the Privacy Act.

3. How does IE collect personal information?

3A. IE generally collects personal information directly from the individual from various application forms submitted to IE by the individual however we also receive information via other channels such as when individuals utilise services or goods from IE and make payment for those goods or services; when IE requires bank account details from individuals or other creditors who request payment from IE’s services and associated businesses; when an individual enters into a competition or votes/becomes connected on a social media post; from job applications when individuals apply for jobs at IE; from contributions made via social media (including Facebook, Twitter and Instagram; or via telephone, email, written and in-person inquiries directed or made directly to IE.

3B. If we require the collection of personal information about you from a third party and it is unclear whether you have consented to the disclosure of that personal information to us, we will take reasonable steps to contact you and ensure that you are aware of the circumstances surrounding the collection and the purposes for which we have collected your personal information.

4. Why does IE collect, hold and/or use personal information?

4A. Generally, we only use personal information for the primary purpose for which we have collected it, or for closely related business purposes. For example, IE collects personal information to fulfill its role as an Australian Music Industry association including, for the purpose of; compiling the Atomic Countdown; distributing licence fees and royalties; managing memberships to IE’s services; organising the annual Atomic Hundred; managing business relationships; administering the database for its ISRC records as required by ARIA; operating competitions and contacting winners of said competitions; reviewing and assessing job applications; responding to inquiries and complaints; receiving and making various payments and educating the public about IE’s online services and products.

4B. In most cases, the primary purpose for which we need personal information will be apparent from the context in which we collect it. If this is not the case, we will take steps to specify our purpose at, or as soon as possible after, the time of collection. We may also use personal information to send you information about our activities, or about goods or services that we believe may be relevant or useful to you If at any time you do not wish to receive such information, please let us know by contacting our team via email – info@atomicmusic.space

4C. In other respects, we will only use personal information with your consent, or if we are required or permitted by law to do so (eg. Under the APPs in the Privacy Act).

5. Who does IE disclose personal information to?

5A. IE generally only discloses personal information about other persons or organisations for the primary purpose for which we have collected it, or with your direct consent (be it explicit or implied from your conduct or from the circumstances in which the information is collected).

5B. We may also disclose personal information if we are required or permitted by law to do so (eg. Under the APPs in the Privacy Act).

6. Storage, security and destruction of personal information

6A. IE takes reasonable steps to ensure the personal information we hold is protected from risks such as loss or unauthorised access, destruction, use, modification or disclosure.

6B. Your personal information is stored on a password protected database and hard copy files which are secured from unauthorised access. We only allow authorised personnel to access personal information, and it is a condition of employment that our employees maintain the confidentiality of all information to which they have access.

6C. We only retain personal information for as long as it is needed by us, or for as long as we are legally required to retain the information. When we are no longer required to retain personal information, we ensure that it is disposed of or destroyed in a secure fashion in accordance with our obligations under the APPs in the Privacy Act.

7. Online privacy issues

7A. IE does not collect personal information about individuals who browse our website HOWEVER this policy applies to any personal information you choose to provide to us online, for example if you fill out a form on our website or send us an email.

8. Google Analytics

8A. Google Analytics is a web analysis service provided by Google. We have implemented a feature of Google Analytics referred to as Demographics and Interest Reporting on this website.

8B. The Google Analytics Demographics and Interest Reporting feature allows us to collect metrics relating to the demographics and interest of all visitors to IE online services. We collect such data to analyse how visitors engage with our website. We do not collect or store personally identifiable information about visitors.

8C. The data collected via the Google Analytics process and Interest Reporting feature is stored on Google’s servers and accessible by Google. By using this website, you consent to the processing of the data by Google as set out in Google’s own Privacy Policy.

8D. You can opt out of Google Analytics if you disable or refuse the cookies, JavcaScript or use the Opt-Out service provided by Google.

9. How do I access, correct and request the deletion of my personal information?

9A. Under the Privacy Act, you generally have the right to seek access to the personal information that IE holds about you, although there are some circumstances in which we may be required or permitted by law to withhold access to some or all of that information. You also have the right to ask us to correct and delete personal information about you that you believe is inaccurate, incomplete or out of date.

9B. If you wish to exercise these rights, we ask that you make a request in writing to our team via email, info@atomicmusic.space. You will need to provide some form of identification (eg. A copy of your drivers licence or passport) so we can verify that you are the individual to whom the personal information relates. You should also include details of how we can contact you in case we need to discuss your request further.

10. How can I make a complain if I believe that IE has breached the APPs

10A. If you would like to make a complaint in relation to this policy or the manner in which we handle your personal information, please contact our team via email – info@atomicmusic.space . We will endeavour to respond to complaints within 30 days of their receipt.

10B. If you are dissatisfied with our response, you may refer the matter to the Australian Information (Privacy) Commissioner at http://www.oaic.gov.au
